Franklin represents La Martinière, France’s third largest publishing group, in its lawsuit against Google, with respect to the digitization and online distribution of thousands of books copyrighted by La Martinière.
On December 18, 2009, the first-level court in Paris (Tribunal de Grande Instance de Paris) found Google guilty of copyright infringement. The court awarded 300,000 euros in damages to La Martinière’s three publishing companies, on the basis of 300 books, and enjoined Google from further digitizing and distributing books, subject to a daily fine of 10,000 euros for non-compliance. The court also ordered the publication of the judgment in three newspapers and on the “Google Book Search” homepage. The court’s judgment is enforceable immediately. Google has announced its intention to appeal this adverse decision. |
