The order of 15 September 2021 introduced into French law the concept of absolute priority and the best interests of creditors test. In a ruling of uncertain scope, the pragmatic assessment of the fundamental concepts of the reform raises questions about the guidelines that the Court of Cassation wishes to adopt for the classes of affected parties.
