The EU E-commerce Directive has been implemented into French law. The digital Economy Law implements the directive's provisions almost word for word on most issues, while adding a number of French twists, in particular with regard to Internet service provider liability, online communication and encryption.

A tribunal has ruled that no valid agreement existed in a case where a consumer ordered a product from a website which offered the item at approximately one-tenth of its usual price. The tribunal held that the price resulted from a material price labelling error on the e-merchant's website and did not express the e-merchant's consent to sell the item at that price.

A court has ruled that the activities of companies which provide web hosting on an integrated basis with other services must be assessed separately when determining what liability rules apply. Previously, it was unclear whether multi-service providers were eligible for a liability limitation that applies to providers whose sole activity is hosting.
