Legislation adopted in august 2006 has established rules aimed at deterring unfair practices in distance reverse auctions. This represents an important step towards preventing unfair practices and promoting confidence in these auctions, as it creates a framework with broad transparency and non-discrimination principles - which are enforced by penalties in case of breach.

After the invalidation of 33 clauses in the AOL internet access agreement, it was the turn of another major internet service provider, Tiscali, to have a substantial number of provisions of its standard subscription agreement struck down. The Paris Tribunal of First Instance held 24 out of the challenged 25 clauses to be either unfair or illegal.
