The firm’s New Technologies department, led by Bradley Joslove, has gained recognition as one of the leaders in France in the areas of information technology, telecommunications and Internet law. The team advises service providers, including some of the leading operators in the sector, as well as their French and foreign corporate customers.
First, the department has deep experience in the fields of information technology, Internet, e-commerce and information system security, covering the main operations in each sector:

Information technology : all types of contracts, including development, integration, licenses, distribution, maintenance/assistance, facilities management, ASP services, etc.

Internet and e-commerce : website development agreements, negotiation and drafting of agreements on multimedia projects, drafting of contractual terms for the supply of online services, privacy policies, etc.

Information system security : advice concerning legal requirements with respect to personal data (including relations with the CNIL) and encryption (declarations and requests for authorization of encryption products and services), and the protection against software piracy.
 
Second, as part of its telecommunications practice, the department advises service providers on matters of market entry and assists them in negotiating and drafting contracts in relation to their operations.

Drafting and negotiation of contracts in the realm of fixed and mobile telephone services, satellite or cable service, network architecture design and service resale.

Participation in a large number of restructurings, mergers and acquisitions, as well as industrial and commercial alliances involving leading operators in the telecommunications sector.

Close collaboration with Franklin’s public sector and competition law teams to handle cases involving public service concessions, rights-of-way, corporate alliances and concerted practices.

Finally, the New Technologies department has developed a significant practice in the field of national and international outsourcing transactions mainly concerning telecommunications and information technology. The outsourcing projects in which Franklin has been involved ranged from the worldwide outsourcing by major international group of all of its telecommunications (fixed, mobile, international and local telephone services, call centers, data transport, paging, videoconferencing, etc.) to selective outsourcing transactions limited, for example, to private virtual networks, call centers, intranets, facilities management, database hosting or management in one or a few countries.
